2. Petitioner seeks regular bail in connection with Muffasil P.S. Case No.107 of 2024 registered under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 76, 352, 351(2) and 3 of B.N.S. and Section 27 of the Arms Act.

3. As per prosecution case, the accused persons including petitioner armed with deadly weapons came to the house of informant and petitioner took out pistol from his waist and fired on the informant which did not hit him, thereafter petitioner is alleged to have given iron blow on his head which hit on his forehead. Patna High Court CR. MISC. No.52128 of 2025(2) dt.12-08-2025 2/3 accused Amit Kumar assaulted the nephew of the informant with iron rod. Petitioner is further alleged to have snatched Rs.2000/- from Ram Pyaree Devi and torn her clothes.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The Petitioner is alleged to have assaulted the informant with pistol but no pistol has been recovered from possession of the petitioner and the allegation of use of firearm is a concocted story. The allegation of assaulting with iron rod to Khaltu Verma is attributed to the petitioner but the injury has been found to be simple in nature. The charge sheet has already been submitted and there is no chance of tampering with the evidence or absconding of the petitioner. Petitioner has five criminal antecedents but in all cases, he is on bail. Petitioner is in jail since 10.02.2025 and he undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,
