The petitioner has filed the instant application for grant of regular bail in connection with Paraiya P.S. Case no. 206 of 2020 registered under section 354B, 457 and 380 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that on waking up late in the night, she found the petitioner trying to force himself on her. On raising hulla, taking sum of Rs. 50,000/, he fled.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. He has been falsely implicated in the case. He is in

Patna High Court CR. MISC. No.8358 of 2021(3) dt.08-07-2021 2/2 custody since 11.8.2020, has no criminal antecedent and investigation in the case has concluded.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for nearly 9 months and investigation in the case having concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Paraiya P.S. Case no. 206 of 2020 on furnishing bail bond of Rs. 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
