JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-07-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Kanti P.S. Case No. 375 of 2021 registered for offence punishable under sections 448, 147, 341, 323, 307, 354, 379, 380, 504, 506 of the Indian Penal Code and sections 3/4 of the Dayan Act. As per allegation, the petitioners and other accused persons assaulted the informant and his family members. The specific allegation against petitioner no. 1 is to assault the husband of the informant.

The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.61489 of 2021(2) dt.13-07-2022 2/2 that there is case and counter case, both the parties have sustained injuries and the petitioners are the persons of clean antecedents. Though, the specific allegation against petitioner no. 1 is that he has assaulted the husband of the informant with iron rod on his head, but there is no injury on the person of the husband of the informant.

Considering the above-mentioned facts and circumstances as well as the clean antecedents of the petitioners let them, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, West, Muzaffarpur in connection with Kanti P.S. Case No.375 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
