The petitioner has been in custody since 21.05.2018 in connection with Gwalpara P.S. Case No. 84/2018 registered for the offences punishable under Sections 420/414 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner was apprehended with the vehicle in question on suspicion, the vehicle which the petitioner was riding was not the stolen vehicle, but he had purchased the same in lieu of certain loan which has given to the nephew of the owner of the vehicle and, therefore, the petitioner has been implicated in connection with the present theft of motorcycle in question. Learned counsel for the petitioner further submits that it was under the belief that

No.46108 of 2018 (2) dt.29-08-2018 2/2 the vehicle in question was available for sale and the petitioner had received the same in lieu of the debt, and the petitioner has a clean antecedent. It is further submitted that the ownership papers were not available with the petitioner so as to enable him to ascertain that the papers were forged or fabricated. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Gwalpara P.S. Case No. 84/2018.
