Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner seeks bail in a case initially registered under Section-379 of the Indian Penal Code in which, later on, charge sheet was submitted under Sections-392, 412/34 of the Indian Penal Code.

Allegedly, tractor of the informant was stolen away by miscreants.

It has been submitted that there is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.51748 of 2022(2) dt.16-12-2022 2/2 petitioner is in custody since 12-04-2022. Charge sheet has already been submitted in this case. The petitioner is not named in the FIR. The name of the petitioner has transpired in the present case on the basis of self-confessional statement of the accused. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. The petitioner has not been put on TIP to ascertain his participation in the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Sugauli P.S.
