====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 07-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 26.06.2019 in a case for the offence registered under Sections 341, 323, 448, 354(B), 379, 506 of the IPC. Later on, Section 8 of POCSO Act was also added.

The prosecution story, in brief, is that on 07.03.2019 at about 11.00 A.M. Ram Ekwal Yadav (petitioner) entered into the house of the informant and with bad intention started removing the cloth of her minor daughter, namely, Niharika Kumari and on protest made by her, he started assaulting the informant with fists and slaps. It is further alleged that the petitioner tried to malign the prestige of her daughter and he

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Both parties are neighbour. Due to land dispute. The alleged occurrence is said to have taken place. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1st-cum-Special Judge, Kaimur at Bhabua, in connection with POSCO Reg. No. 13 of 2019, arising out of Chainpur P.S. Case No. 97 of 2019.
