JUSTICE BIRENDRA KUMAR ORAL ORDER 25-09-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420,406,409,431,447/34 of the Indian Penal Code. The complaint regarding inferior quality of work, in construction of road was made only after the road started damaging.

Submission is that the petitioner was Mukhiya. The road is being constructed on the technical report of the engineers. Moreover, the Committee, who enquired the allegation, did not find substance in the allegation. Considering the aforesaid fact, let the petitioners,

No.50722 of 2018 (2) dt.25-09-2018 2/2 above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sangrampur P.S.Case No. 121 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
