The petitioner apprehends his arrest in a case under Sections 365/34 of the Indian Penal Code.
On the basis of the information of the complaint, earlier an F.I.R. was lodged against the petitioner and others for kidnapping of the husband of the complainant, Rajeev Bhagat. The police, after investigation, submitted final form finding the case false but thereafter the complainant filed protest and, on such, the case proceeded. The complainant merely suspected that her husband was mentally ill and, on the pretext of getting him treated at Ranchi, the petitioner and others kidnapped him. There appears that on mere suspicion, two other similarly situated accused
Patna High Court Cr.Misc. No.16521 of 2015 (2) dt.01-05-2015 2/2 persons, namely Randhir Kumar Bhagat @ Suraj Kumar and Sita Devi have already been enlarged on anticipatory bail. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender in the court below within four weeks from today, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Madhepura in Complaint Case No. 1080C of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
