JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially registered for the offences punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code, Section 27 of the Arms Act and later on, Section 302 of the Indian Penal Code was added. Petitioner is said to have opened fire causing firearm injury on the abdomen of the deceased and earlier his prayer for bail was twice rejected by this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, again, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with S. T. No. 02 of 2017/202 of 2018 arising out of

Patna High Court Cr.Misc. No.51934 of 2018 (2) dt.12-09-2018 2/2 Haspura P. S. Case No. 35 of 2011 pending in the court of Additional Sessions Judge-IVth, Aurangabad stands rejected. However, the learned trial court should expedite the trial of the petitioner.
