Petitioner prays for bail in connection with Bhorey P.S.Case No. 99 of 2018 registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioner is that impugned order shows that the victim in her statement under Section 164 Cr.P.C. has stated that she went to Delhi along with the petitioner and remained there in a room and while she was returning from Delhi, she was apprehended by police and as such she appears to be a consenting party and medical report shows her age as 17-18 years and petitioner is in custody since 10.1.2018.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XII, Gopalganj, in connection with Bhorey P.S.Case No. 99 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
