NILU AGRAWAL ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel appearing on behalf of Bihar State Cooperative Land Development Bank, Patna (hereinafter referred to as the Bank).

2. In pursuance to the order dated 19.04.2019 a cheque drawn on Bank of India bearing No. 034195 dated 26.04.2019 for an amount of Rs. 15,757/- has been produced, which the Bank submits is the payment with regard to gratuity.

Patna High Court CWJC No.2866 of 2017(4) dt.30-04-2019 2/2 The same is handed over to the counsel for the petitioner, who is directed to grant receipt on the margin of the order-sheet.

3. So far payment of leave encashment and arrears of salary is concerned, the Bank is directed to make payment to the petitioner on the basis of the methodology fixed by this Court in the case of Kamla Prasad Sharma Vs. The State of Bihar & Ors. in C.W.J.C. No. 14799 of 2012 duly affirmed by the Division Bench in L.P.A. No. 1328 of 2015.
