====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 09-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 364, 365, 302, 201, 34 of the I.P.C.

According to FIR, the petitioner and four others by causing threat took Ramayan Sahani, the son of the informant with them on a four wheeler. This occurrence took place on 18.10.2019, however, FIR was lodged on 22.04.2020 for which there is no plausible explanation.

Submission is that investigation is complete now and the victim is still traceless. No other witness has supported the prosecution case. Petitioner is in custody since 24.04.2020. Considering the facts of this case aforesaid, specially

No.8541 of 2021(3) dt.09-08-2021 2/2 the delayed FIR suggests that the informant had not seen the petitioner or others committing the crime or at least using force against the victim otherwise the matter would have been reported to the police at once, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sahebganj P.S. Case No. 195 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
