JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 20.4.2018 seeks bail in Goraul PS Case No. 85 of 2016 registered under Sections 376, 341, 323, 504 and 120B of the IPC.

Accusation is that the petitioner on the pretext of getting married with the prosecutrix sexually exploited her for last five years, only a few days back she learnt that he was going to marry with another girl so she protested then again the same kind of offence was repeated.

Learned Counsel for the petitioner submits that the girl is major 22 years of age, the relationship between both were consensual as per the allegation itself and in order to put pressure upon the petitioner this false case was instituted. Having considered the aforesaid facts and circumstances, the petitioner, namely, Rahul Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Vaishali at Hajipur in connection with Goraul PS Case No. 85 of 2016.
