15-06-2015 Heard Sri N.K.Agrawal, learned Senior Counsel, who was assisted by Sri D.N.Tiwary, learned counsel for the petitioner and learned Addl. Public Prosecutor.

The petitioner, who apprehends his arrest in connection with Katihar (T) P.S. Case no.141 of 2015 registered for the offence under Section 414 of the Indian Penal Code and 7 of the E.C.Act, has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that though the petitioner is a dealer and deals in foodgrain, no offence is made out. He further submits that it is a fit case for grant of anticipatory bail.

I have perused the materials available on record. I do not find any ground for extending the privilege of anticipatory

Patna High Court Cr.Misc. No.19097 of 2015 (2) dt.15-06-2015 2/2 bail. If so advised, the petitioner may appear before the court below and make a prayer for regular bail. If such petition is filed before the court below within a period of one month from today, the learned court below, without being prejudiced with this order, may examine the same and pass appropriate order in accordance with law preferably on the same day.
