JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 10-06-2015 The petitioner, who is the husband, apprehends his arrest in relation to Complaint Case No. 2355/2013 instituted under Sections 498(A), 323, 379 & 3/4 of the Indian Penal Code by the wife.
The complainant alleges that she was being tortured and thrown out of the house of the petitioner. On the other hand, on behalf of the husband, it is submitted that the marriage was against his Will and he had come to know that the girl was not mentally normal, result is that the marriage is never consumed. A panchayati was held and the Panches realizing that the marriage is void and gifts which were received be returned to the complainant, but now father-in-law of the petitioner is demanding more money to agree to break the marriage and separate

Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the petitioner, namely, Rajesh Sah @ Raju Sah, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Chapra (Saran), in connection with Complaint Case No. 2355 of 2013, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
