Petitioner seeks bail in Naubatpur P.S.Case No. 430 of 2020 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier, the bail prayer of petitioner was rejected vide order dated 15.03.2021 in Cr. Misc. No. 37688 of 2020 with direction to the trial court to conclude the trial within six months and if the trial is not concluded within specified time, the petitioner may renew his prayer for bail It is submitted on behalf of the petitioner that till date, only charge has been framed, but there is no substantial

It is further submitted that as per F.I.R itself, petitioner is alleged to have assisted the co-accused Sujit Kumar in killing the deceased in which, petitioner also sustained one fir-earm injury. Similarly situated co-accused persons Rahul Kumar @ Lallu in Cr. Misc. No. 12901 of 2021 vide order dated 15.06.2021 and Manoj Kumar @ Mantu Verma@ Manoj Verma in Cr. Misc. No. 41565 of 2021 vide order dated 03.01.2022 have been granted bail by a co-ordinate Bench of this Court. Petitioner is in custody since 29.08.2020.
Considering the aforesaid facts and circumstances as well as period of detention of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge,V, Danapur in connection with Session case no. 284 of 2021 arising out of Naubatpur P.S.Case No. 430 of 2020.
