The petitioner apprehends his arrest in connection with Deokund P.S. Case No. 05 of 2019, registered under Sections 406, 420 and 120(B)/34 of the Indian Penal Code. The accusation is that the informant, who is doing the wholesale business of grains, collected the paddy of Rs.11,00,000/- on credit and supplied to Deepak Kumar Gupta and his brothers, namely, Ranjeet Kumar (petitioner) and Ranjan Gupta but they did not pay the price of paddy. In spite of much persuasion, Asha Devi and Meena Devi, wife and mother of Deepak Kumar Gupta, Punam Devi wife of petitioner and other relatives are also assured to the informant to pay the price of

Learned counsel for the petitioner submits that, in fact, petitioner is brother of Deepak Kumar Gupta, who used to do wholesale business of grains and informant supplied the paddy to Deepak Kumar Gupta due to that reason petitioner and his other family members have falsely been implicated in this case and petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad, in connection with Deokund P.S. Case No. 05 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
