The petitioners, namely, Deepak Singh and Ajay Singh @ Ajay Kumar Singh in Cr. Misc. No. 14272/2015 and Cr. Misc. No. 18215/2015 respectively apprehend their arrest in Bakhtiarpur (Balwahat O.P.) P.S. Case No. 77/2012 under Sections 307 and 34 of the Indian Penal Code and Section 27 of

Patna High Court Cr.Misc. No.14272 of 2015 (2) dt.08-05-2015 2/2 the Arms Act.

The informant named four persons, namely, Lalit Singh, Dharambir Singh, Ajay Singh (the petitioner) and Deepak Singh (the petitioner) and alleged that they along with other unknown criminals made indiscriminate firing. The firing made by Lalit Singh hit on the thigh of the informant. It is submitted that Lalit Singh and Dharambir Singh have already been enlarged on anticipatory bail vide order passed in Cr. Misc. 48681/2014. The case of the petitioners stands on better footing. The informant made his statements under Section 164 Cr.P.C. but did not name the petitioners.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender in the court below within four weeks from today, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Bakhtiyarpur (Balwahat O.P.) P.S. Case No. 77 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) Dilip/- U T
