====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-07-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
3. As per prosecution case, 233.280 liters illicit liquor was recovered from the seized car. Petitioner no. 2 is owner of the seized car in question and petitioner no. 1 is son of petitioner no. 2, who is alleged to have fled away from the spot.
4. Learned counsel for the petitioners submits that no incriminating material has been recovered from conscious possession of these petitioners. Petitioners have got no concern
Patna High Court CR. MISC. No.49758 of 2025(2) dt.22-07-2025 2/2 with the alleged recovery and they have been made accused in this case only on suspicion. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
6. Considering the fact that petitioner no. 2 is owner of the seized car from which huge quantity of illicit liquor was recovered, prayer for anticipatory bail of the petitioners is refused.
