Petitioner is apprehending his arrest in connection with Sonbersa Raj P.S.Case No.21/19 , registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR on the occasion of the marriage of the sister of the co-accused Ashish Kumar Singh, D.J. programme was going on in which some one fired from his Rifle causing death of the niece of the informant, who was performing dance. Petitioner is not named in the FIR and later on from the CCTV footage name of the petitioner also transpired holding pistol. Submission of the learned counsel for the petitioner is that there are seven CCTV footage and one of the CCTV footage clearly discloses that the firing was made by Niraj Kumar Singh, who has already been granted privilege of the

Patna High Court CR. MISC. No.48416 of 2019(3) dt.15-11-2019 2/2 anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 5.4.2019 passed in Cr. Misc. No.21542 of 2019 and at best the footage only show that he was also holding pistol and further shows that several persons were also holding pistol. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Rajesh Kumar VIth, J.M. Ist Class, Saharsa in connection with Sonbersa Raj P.S.Case No.21 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
