2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 467, 46 , 471 and 120-B of the Indian Penal Code.
3. As per the prosecution case, informant namely Vikash Kumar alleged that in the year 2018 this petitioner along with other co-accused persons came at the house of informant and took informant to Surat to provide job and as such , accused
Patna High Court CR. MISC. No.49574 of 2025(2) dt.19-08-2025 2/3 persons took signature of informant on several papers, like Aadhaar Card, Pan Card, thumb impression and bank documents and thus, committed fraud with informant in lieu of providing job to him.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case . As per F.I.R. incident took place in the year 2018 but the present F.I.R. has been lodged after inordinate delay of 6 years for which there is no plausible explanation which itself creates doubt over the veracity of entire prosecution case . It is further submitted that there is no allegation that this petitioner ever withdrew money from rthe account of informant or misused his documents. Petitioner claims clean antecedent. Similarly situated coaccused persons have already granted bail by this Court vide order dated 21.09.2024 in Cr. Misc. No. 62900 of 2024 . 5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts, materials available on record and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.49574 of 2025(2) dt.19-08-2025 3/3 each to the satisfaction of the learned Chief Judicial Magistrate Aurangabad in connection with Navinagar P.S. case No. 125 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
