1. Initially, the Writ petition was filed challenging the notice under the SARFAESI Act. At the time of admission, this Court passed a status-quo order, to be maintained by the party vide order dated 18.05.2017. The Learned counsel for the respondent Punjab National Bank, reported to the Court that the entire amount of the loan has been repaid, by the coborrower named Davendra Prasad Singh, S/o late Deepu
Patna High Court CWJC No.6190 of 2017(2) dt.28-01-2025 2/2 Singh and his wife Chameli Devi, and no outstanding amount is pending as of today. Therefore, nothing remains in this Writ petition for adjudication.
2. Considering the fact that the entire loan amount has been repaid, the notice under SARFAESI Act will not survive.
3. Initially, the respondent was Oriental Commerical Bank, which has now merged with Punjab National Bank.
4. With the aforesaid observations, the Writ petition is disposed of.
