====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Shastri Nagar P.S. Case No. 199 of 2021 registered for the offences punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The allegation as per the First Information Report is that the Police raided the house of the petitioner along with other accused persons and recovered a total quantity of 404 litres of country made liquor and the petitioner along with others was arrested by the Police.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.62202 of 2021(2) dt.23-05-2022 2/2 petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with oblique motive. The house from where the illicit liquor has been recovered is a joint family house. The petitioner is in custody since 2.6.2021.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 2.6.2021, charge sheet has already been submitted and there is no apprehension that the petitioner will abscond and tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Shastri Nagar P.S.
