JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 09-06-2015 The petitioners apprehend their arrest in relation to Narari Kala Khurd P.S. Case No. 05 of 2014 registered under Sections 307, 379, 341, 323, 504, 147, 148, 149 of the Indian Penal Code.

Learned counsel for the petitioners seeks leave to withdraw this application so far as petitioner no. 3 is concerned inasmuch as he has been arrested. Accordingly, this application stands dismissed as withdrawn only with regard to petitioner no. 3 namely, Mahendra Singh.

Learned counsel for the petitioners submits that main allegation of assault is on Sudama Singh and

Patna High Court Cr.Misc. No.17747 of 2015 (2) dt.09-06-2015 Krishna Singh who have already been granted anticipatory bail by order dated 30.04.2015 passed by this Court in Cr. Misc. No. 52214/2014.

Learned counsel for the petitioners further draws attention of this Court to the fact that the dispute had started when procession of emersion of idol of Saraswati was being taken.

Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the petitioners, namely, Yogesh Singh @ Yugesh Singh, Arun Singh, Satendra Singh @ Satyedra Singh @ Satyendra Singh, Ajit Singh, Rajaram Singh and Sheopujan Singh, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Narari Kala Khurd P.S. Case No. 5/2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
