JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his application for grant of pre-arrest bail by way of filing an application under Section 438 of the Code of Criminal Procedure in connection with Town P.S. Case No. 369 of 2003 registered under Sections 420, 467 & 471 of the Indian Penal Code. The prayer for grant of pre-arrest bail of the petitioner was earlier rejected by this Court vide order dated 28.03.2012 passed in Cr. Misc. No. 12766 of 2012. Though the case is of year 2003 and the prayer for grant of pre-arrest bail of the petitioner was rejected by this Court in March, 2012, till date he has not surrendered before the court below and while remaining absconding he has ventured to file another application for grant or pre-arrest before this Court.
