Heard learned counsel for the parties.

The petitioner seeks anticipatory bail in connection with Khanpur P.S. Case No. 135/2021, registered for the offence under Section 366/34 of the Indian Penal Code. The main allegation is that this petitioner and four accused persons abducted the informant's sister and thereafter demanded Rs. 10,000/- in lieu of releasing the said victim. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is innocent and has committed no offence.

Having heard both sides and perused the F.I.R. The alleged occurrence relates to abduction. The petitioner is named in the F.I.R. It has been alleged that one co-accused established sexual relationship forcefully with the said victim and in that course, this petitioner and other co-accused guarded the main accused, who committed the offence of rape and the said facts have been revealed by the victim in her statement recorded under Section 164 Cr. P.C. Moreover, admittedly against this petitioner five criminal cases are pending and the present case is under investigation. Considering above facts, it is not a fit case for grant of anticipatory bail to the petitioner. Accordingly his prayer of anticipatory bail stands rejected.
