2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 379 and 461 of the Indian Penal Code.
3. It is a case of theft. Name of petitioner has transpired in this case during course of investigation, on the basis of confessional statement of co-accused person.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case, merely on the basis of confessional statement of co-accused person. Petitioner is not named in the F.I.R.. Petitioner claims clean antecedent.
5. On the other hand, learned A.P.P. for the State has
Patna High Court CR. MISC. No.56279 of 2024(4) dt.07-01-2025 2/2 vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that certain stolen articles have also been recovered from the house of this petitioner.
6. Considering the aforesaid facts and circumstances, nature of accusation and the fact that certain stolen articles have been recovered from house of this petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
