JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-05-2018 The writ petitioner by way of the present writ petition has prayed for grant of promotion to the post of Joint Commissioner, Commercial Taxes.

A supplementary affidavit has been filed by the petitioner annexing the notification dated 05.12.2017 issued by the Commercial Taxes Department, whereby the petitioner has been granted promotion to the post of Joint Commissioner with effect from 05.12.2017. Now the grievance of the petitioner is that the person junior to him, namely, Shri Ashok

Patna High Court CWJC No.6405 of 2017 (4) dt.08-05-2018 2/2 Kumar Sharma has been granted promotion to the post of Joint Commissioner, Commercial Taxes with effect from 15.06.2016, hence the petitioner ought to have been granted promotion with effect from 15.06.2016.

In view of the aforesaid, the respondent no. 2 is directed to consider the aforesaid aspect of the matter and take a final decision with regard to the shifting of the date of promotion of the petitioner on the post of Joint Commissioner from 05.12.2017 to 15.06.2016 within a period of four weeks from today.
