2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 448, 324, 326, 307, 120(B) and 304 of the Indian Penal Code and Sections 27 of the Arms Act.

As per prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons including this petitioner and 3-4 unknown persons, armed with weapons, abused the informant and thereafter, on the exhortation of this petitioner, other co-accused persons started firing at informant, as a result of which, informant sustained 1516 fire-arm injuries.
4. It is submitted on behalf of petitioner that at the
Patna High Court CR. MISC. No.56023 of 2023(2) dt.30-08-2023 2/2 time of occurrence, petitioner was not present at the place of occurrence and he has been falsely implicated in this case. There is no allegation against this petitioner that he has fired upon the informant, rather he is only alleged to have given order to other co-accused persons to kill the informant.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is named in the F.I.R. and there is specific allegation that he alongwith other coaccused persons committed such crime, as a result of which, informant sustained 15 fire-arm injures. Besides this, petitioner has got criminal antecedent and he is accused in six more cases.
6. Considering the nature of accusation and criminal antecedent, the prayer for anticipatory bail of petitioner is rejected.
