JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-08-2019 This application, for grant of anticipatory bail, arises out of G.B. Nagar P.S. Case No. 77 of 2019, disclosing offences under Sections 272, 273 and 308 of the Indian Penal Code and Section 30 (a), 36, 38, 41(1) fo the Bihar Prohibition and Excise Act, 2016.
Nine accused persons including the petitioner are named in the F.I.R. and the allegation as per F.I.R. is that from the house of co-accused Vinod Choudhary 03 litres of country made liquor was recovered and he disclosed the name of petitioner Submission of learned counsel for the petitioner is hat he has no criminal antecedent and has falsely been implicated in this case on the disclosure of co-accused and there is no recovery from the house of the petitioner.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with G.B. Nagar P.S. Case No. 77 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
