The petitioner seeks bail in Naubatpur P.S. Case No. 69 of 2021, registered for the offence punishable under Sections 307/34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the informant was going to Patna from his village, on the way, two bike borne miscreants came and pillion-rider of the said motorcycle fired upon him thrice, thereafter, both of them fled away. It is further alleged that petitioner and co-accused Nandan Singh and other co-accused persons after hatching up conspiracy committed the alleged occurrence.

It is submitted on behalf of the petitioner that petitioner is alleged to be one of the conspirators and there is no specific overt act has been raised against this petitioner.

Counsel for the informant however, vehemently opposed the prayer for bail and submitted that petitioner is named in the FIR and has got criminal antecedents. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Danapur, Patna in connection with Naubatpur P.S.
