2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 414 of the Indian Penal Code, registered in connection with Kuchaikote P.S. Case No. 197 of 2024.

3. As per allegation, the police stopped the Ertiga vehicle. The petitioner who was the driver tried to flee away and after chase he was apprehended.

4. The learned counsel for the petitioner has submitted that the Ertiga car was not the stolen property. As a matter of fact, the petitioner was not driver of that car. He was gratuitous passenger and he is resident of Darbhanga district. The person,

Patna High Court CR. MISC. No.55056 of 2024(2) dt.20-08-2024 2/2 who was driving the car became successful in fleeing away and this innocent person was apprehended by the police. He is under custody since 06.05.2024.

5. Learned APP appearing for the State has opposed the prayer of Bail.

6. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing the bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Class, Gopalganj in connection with Kuchaikote P.S. Case No. 197 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court.

(ii) After accepting the bail bond, criminal antecedent of the petitioner shall be verified from the Senior Superintendent of Police, Darbhanga.
