The petitioners being brothers and father of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B, 328, 201 and 34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant within one year of marriage by administering poison. It is submitted by learned counsel for the petitioners that the accusation is general and omnibus. In fact, the victim died due to snakebite. The post-mortem does not reflect anything and the viscera has been preserved. It is further submitted that the informant has retracted from initial version

Patna High Court Cr.Misc. No.15361 of 2015 (2) dt.15-04-2015 2/2 and has filed a petition to that effect before the learned court below.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Ekma P.S. Case No.31 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
