1. To issue a writ in the nature of mandamus or any other appropriate writ/ writs, order/ orders, direction/directions
Patna High Court CWJC No.3620 of 2021(2) dt.10-08-2022 2/3 commanding the respondents for the following:- i. To direct the respondents to remove the encroachment from the Govt. land of the Mauza- Rahthua, Khata No. 417 Khesra no. 2281 total area 50 decimal. ii. To direct the respondents to remove the encroachment of the Nala according to the khatiyan (Annexure3). iii. To direct the respondents to remove the respondents no. 6 to 11 who encroached the Govt. land and obstruct the Nala of the Dalit Basti of Rahthua village, Buxar. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Respondent No. 5 i.e. the Circle Officer, Brahampur, Buxar for redressal of his aforesaid grievances. Liberty so sought is granted.
It is needless to state that in case appropriate petition is filed by the petitioner under the provisions of the Bihar Public Land Encroachment Act, 1956 before the Respondent No.5 within a period of four weeks from today, appropriate orders shall be passed thereon, in accordance with law, and after hearing the affected parties within a period of 12 weeks, thereafter.
