The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code to which section 395 of the Indian Penal Code was added subsequently.

As per the prosecution case, the accused persons with their faces covered on the point of arms robbed the informant of his belongings including a laptop, mobile phone, Rs. 1400/- in cash etc.

It is submitted by learned counsel appearing for the petitioner that the FIR was registered against two unknown. Referring to the order of the learned trial Court it is submitted that the name of the petitioner transpired in the confessional

Patna High Court CR. MISC. No.62303 of 2021(2) dt.12-04-2022 2/2 statement of co-accused Satin Kumar made before police. The said Satin Kumar has himself been enlarged on bail. No incriminating article has been recovered from the possession of the petitioner. The petitioner is in custody since 28.7.2021 and charge sheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially grant of bail to Satin Kumar on whose confessional statement the name of the petitioner transpired together with charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Jalalpur P.S Case no. 10 of 2016 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-XIII, Saran, Chapra.
