The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 97 of 2022 instituted for the offences under Sections 25(1-b) a, 26 and 35 of the Arms Act.
In this case, the petitioner has been saddled with the charge of being in possession of four live cartridges. He is in custody since 16.03.2022.
The petitioner was earlier made an accused in Jagdishpur P.S. Case No. 96 of 2022 for an offence under Section 395 of the Indian Penal Code, in which three
Patna High Court CR. MISC. No.51751 of 2022(2) dt.22-12-2022 2/2 persons were arrested but looted cash was recovered only from the possession of a co-accused. The co-accused in that case and the petitioner, both, were granted bail in Jagdishpur P.S. Case No. 96 of 2022 as noted above. Regard being had to the afore-stated facts and taking into account the period of custody of the petitioner in this, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Bhagalpur, in connection with Jagdishpur P.S.
