The petitioner seeks bail in Bahadurpur P.S. Case No. 61 of 2020, registered for the offence under Section 394 & 307 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, two unknown miscreants, on the point of pistol, entered the shop of informant, which was objected by the informant, upon which, one of the miscreant fired at him, which hit on the leg of the informant and thereafter, both miscreants, after looting cash of Rs. 80,000/-, mobile phone and other relevant documents, fled away. Name of the petitioner has transpired during course of investigation on the basis of his confessional statement. No looted article has been recovered from the conscious possession
Patna High Court CR. MISC. No.61970 of 2021(2) dt.15-02-2022 2/2 of the petitioner. Petitioner claims clean antecedent and he is in custody since 22.09.2020.
However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against this petitioner of causing fire-arm injury to the informant. It is further submitted that petitioner has got criminal antecedent of similar nature of cases.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
