The petitioner seeks bail in a case instituted for the offences under Section307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution case, in short, is that while the nephew of the informant along with one another person were coming, the accused persons fired at him and got injured. The accused persons looted some cash amount.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.4.2018 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. The petitioner is not named in the F.I.R.. His named has transpired on the basis of confessional statement
Patna High Court Cr.Misc. No.50131 of 2018(2) dt.13-09-2018 2/2 of co-accused namely Surendra Pandey. There is no substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -III, Madhubani in connection with Khutauna P.S. Case No. 32/2018, G.R. No. 374/18.
