JUSTICE SANJAY PRIYA ORAL ORDER 25-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Dalsingsarai P.S. Case No. 379 of 2015 instituted for the offence under Sections 302, 201 and 34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. His name has come during investigation merely on suspicion. There is no substantive evidence against the petitioner.

In the written report it is alleged that son of the informant had left the house and did not return. The informant heard rumour that a dead body was lying in Jalalpur Goryari Chour. He went there and identified the dead body of his son Arjun Sahni. It is further alleged that deceased used to visit the house of one Babita Devi. Babita Devi along with her associates

Patna High Court Cr.Misc. No.48503 of 2018 (2) dt.25-09-2018 2/2 must have killed the son of the informant.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Dalsingsarai, Distt. Samastipur, in connection with Dalsingsarai P.S. Case No. 379 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
