JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2018 The petitioner is apprehending her arrest in connection with Kurtha P.S. Case No. 204 of 2016, registered for offences punishable under Sections 419, 420, 468, 471 and 120(B) of the Indian Penal Code.
Allegation as per F.I.R. is that on the basis of certificates of the petitioner, two different persons having similar name Bindoo Kumari are working on post of Panchayat teachers in two different panchayats.
It has been submitted on behalf of the petitioner that there is no allegation against the petitioner that his certificates are forged and she does not as to how those persons got the certificates of the petitioner and petitioner has no role to play in
Patna High Court Cr.Misc. No.50417 of 2018 (2) dt.31-08-2018 2/2 their appointment.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of six weeks and on surrender the court below shall release the petitioner on provisional bail to his own satisfaction till submission of chargesheet and the petitioner shall produce all the documents before the investigating officer for verification and if after submission of charge-sheet allegation against the petitioner is found true, she will have to surrender before the court below and pray for regular bail, which will be considered on the basis of materials available on record.
