====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-06-2022 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 354(B), 379, 307, 504, 506 of the Indian Penal Code.
The prosecution case as per F.I.R is that all the accused persons including petitioners, variously armed entered into the house of the informant and assaulted the father, wife brother of the informant. The accused persons also snatched Rs. 20000/- from the pocket of the informant's father.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.61659 of 2021(3) dt.29-06-2022 2/2 petitioner that both the petitioner and informant are next door neighbour and for a petty dispute, the accusation has been levelled against the petitioner. There is general and omnibus allegation against the petitioner. Moreover, for the alleged occurrence of 23.01.2021, the F.I.R has been registered on 28.01.2021.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahampur (Chakki O.P) P.S. Case No. 56 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
