JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-08-2019 The petitioners apprehend their arrest in connection with Chousa P.S.Case No. 06 of 2019 registered under Sections 307, 323, 341, 342, 354, 504 and 506/34 of the Indian Penal Code. Allegation against the petitioners is that petitioners along with other accused persons assaulted the informant and her family members causing injuries to them.

Learned counsel for the petitioners submits that allegation upon petitioner no. 1 is of assaulting Sonam Kumari by means of knife causing injury on her head. Learned counsel relied upon Annexure-3, which is injury report of Sonam Kumari, and submits that all injuries caused to her are simple in nature and there is case and counter case in between the parties and both parties belong to same village and there was dispute with regard

During the course of argument, learned counsel produced injury report of informant, Anju Kumari and from perusal of the same, it appears that injuries found on her person are simple in nature. After having heard learned counsel for the parties and taking into consideration the fact that injuries caused to the informant and her daughter are simple in nature and there is case and counter case in between the parties and both parties belong to the same village, as such I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned SDJM, Uda-Kishunganj, Madhepura in connection with Chousa P.S.Case No. 6 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
