JUSTICE SANJAY KUMAR ORAL JUDGMENT Date: 03-07-2017 This is an application under Section 482 of the Code of Criminal Procedure wherein the petitioner has prayed to quash the order dated 01.09.2012 passed by the learned S.D.J.M., Aurangabad in Goh P.S. Case No. 124 of 2012.

Heard Mr. Anil Kumar Sinha, the learned counsel for the petitioner, the learned APP for the State and perused the records.

This petitioner is the husband of the Opposite Party No. 2 (complainant) and their marriage was solemnized on 03.06.2004. The complainant has alleged that after marriage, her husband and in-laws started demanding an amount of Rs. 50,000/- for starting
Patna High Court Cr.Misc. No.20037 of 2014 dt.03-07-2017 2/2 business. The said demand was not fulfilled whereupon her husband and in-laws started torturing. It is alleged that her husband and in-laws snatched her belongings and after assaulting, ousted her from their house. The copy of the complaint petition was sent to Police Station where Goh P.S. Case No. 124 of 2012 was registered. The matter was enquired and police submitted chargesheet against this petitioner only. The learned Magistrate after perusing the police report took cognizance against this petitioner under Sections 498A and 494 of the Indian Penal Code. The order of the Magistrate is based on material available on record and the petitioner has failed to make out a case of quashing. 4.
In view of the above facts, I do not find any merit in this application. Accordingly, this Criminal Miscellaneous Application is dismissed.
