JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 16-06-2015 It is the stand of the counsel for the petitioner in the given facts that initially petitioner was on police bail but subsequently cognizance has been taken under non-bailable offences. In the above situation, the ratio of the case from Mahendra Prasad Singh vs. State of Bihar, 2004 (3) PLJR 491, shall come into play.

The application, therefore, is disposed of. The principles laid down and enunciated in the said judgment shall also cover the case of the petitioner.
