Petitioner seeks bail in Belhar P.S. Case No.72 of 2017 instituted for the offence under Section(s) 147, 148, 149, 323, 387, 379 and 504 Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 26.02.2018.

It is alleged in the written report that on the date of occurrence this petitioner along with 10-15 unknown persons arrived and ordered to stop the construction work and abused the informant. It is also alleged that he assaulted the informant with butt of the gun. Other accused persons also assaulted the labourer of the informant when they came to same him.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, III, Banka, in connection with Belhar P.S. Case No.72 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
