On behalf of the respondent, it is submitted that the present application is not maintainable under Article 226 of the Constitution of India as the engagement/appointment of the petitioner was purely contractual in nature and under the scheme of Sarv Shikchha Abhiyan.
Since the engagement was made under a scheme, no statutory right has accrued in favour of the petitioner.
