Petitioner seeks bail in a case registered for the offences punishable under Sections 22,27,29 of the N.D.P.S. Act.

The allegation is that when the police got information and committed raid near railway crossing, some of the miscreants fled away whereas some others were arrested. From possession of arrested person, 820 Mg of smacks was recovered.

Submission is that co-accused-Sunil Minj @ Sunil Driver is also alleged to have fled away and he has been allowed anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 41508 of 2019. Allegation against the petitioner is

Patna High Court CR. MISC. No.48005 of 2019(2) dt.02-08-2019 2/2 identical to co-accused-Sunil Minj @ Sunil Driver. Finding substance in the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Thakurganj Police Station Case No.16 of 2019 giving rise to Special Case No.5(A)/19, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
