JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 07-08-2018 This application under Section 482 of the Code of Criminal Procedure (for short 'the Cr.P.C.') has been filed by the petitioner for quashing the order dated 08.07.2013 passed in Complaint Case No.214 of 2013 whereby and whereunder cognizance of the offences punishable under Sections 323, 354, 385, 454 and 504 of the Indian Penal Code has been taken. It is submitted by the learned counsel for the petitioner that in the said case after taking cognizance of the offences, the petitioner and some other co-accused persons were summoned to face trial. One of the co-accused, namely, K.P.Ramaiah filed an application under Section 482 of the Cr.P.C. before this Court vide
Patna High Court Cr.Misc. No.16504 of 2016 (2) dt.07-08-2018 2/2 Cr. Misc. No.32032 of 2013 which was allowed vide order dated 02.03.2016 and the further proceedings of the complaint including the order dated 08.07.2013 passed in Complaint Case No.214 of 2013 was quashed. He has produced a copy of the order dated 02.03.2016 passed in Cr. Misc. No.32032 of 2013. Let it be kept on record.
In view of the submission that the entire proceedings including the impugned order dated 08.07.2013 has already been quashed in Cr. Misc. No.32032 of 2013, in the opinion of this Court, no order need be passed.
The application stands disposed of.
