JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 408,409,420/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the only allegation against the accused persons is that they did not purchase solar light system from the authorized agency. He submits that petitioner is the Panchayat Secretary of the concerned Gram Panchayat, whereas the Mukhiya of the said Gram Panchayat is also an accused in said Murar P.S. Case No. 50 of 2014 who has been granted anticipatory bail vide an order dated 22.01.2015 passed in Cr. Misc. No. 2671 of 2015.

No.19418 of 2015 (3) dt.09-07-2015 In view of the submissions as above, let the above named petitioner in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Choubey, learned Judicial Magistrate, Ist Class, Buxar in Murar P.S. Case No. 50 of 2014/ G.R. No. 2751 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
