JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272 and 273 of the Indian Penal Code and section 47(a) of Excise Act. 90 liters of country made liquor like raw spirit was recovered. It is alleged that the petitioner along with co accused Ram Kishun Rai was carrying the same on motorcycle but on being intercepted managed to escape from the scene. It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner.

Considering the quantity of recovery, let the learned

No.19335 of 2015 (2) dt.30-04-2015 2/2 court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Motihari Mufassil P.S. Case No. 336 of 2014 pending in the court of learned SDJM, Sadar, Motihari, East Champaran.
